These Terms and Conditions ("Terms") are a legal contract between you and The Kumlawdi Foundation and govern your use of our website, participation in our programs, donations, and volunteer activities. By accessing, browsing, or using The Kumlawdi Foundation's website, making donations, participating in programs, or volunteering, you expressly agree to be bound by these Terms and Conditions.

Participation in The Kumlawdi Foundation programs (including Tampa Flex, Lady YakPak, mentoring, academic support, and other activities) is subject to program-specific eligibility requirements, registration, and completion of required forms. Participants and their parents/guardians (for minors) must provide accurate and complete information during registration.
1.2 Age Requirements
Our programs serve youth participants. Minors must have parental or guardian consent to participate. Parents and guardians are responsible for ensuring their children comply with these Terms and program rules.
1.3 Account Security
If you create an account or register for programs through our website, you are responsible for maintaining the confidentiality of your account information, including your username and password, and for restricting access to your account. You agree and accept responsibility for all activities that occur under your account.
SECTION 2 - DONATIONS AND PAYMENTS
2.1 Donations
The Kumlawdi Foundation accepts donations through our website and third-party donation platforms. All donations are tax-deductible to the extent allowed by law. Donors will receive acknowledgment receipts for tax purposes. Donations are generally non-refundable, except in cases of error or fraud, which will be handled on a case-by-case basis. We may use different donation platforms from time to time, and all donations are processed securely regardless of the platform used.
2.2 Payment Processing
Payment processing for donations is handled by secure third-party payment processors. The Kumlawdi Foundation does not store your full payment card information. All payment information is processed securely in accordance with industry standards.
2.3 Program Fees
Some programs may have associated fees. Fees, payment terms, and refund policies will be clearly communicated during registration. The Kumlawdi Foundation is committed to ensuring no student is turned away due to financial hardship, and financial assistance may be available.
SECTION 3 - PROGRAM PARTICIPATION AND CONDUCT
3.1 Program Rules
Participants agree to:
- Follow all program rules and staff instructions
- Respect coaches, mentors, staff, volunteers, and other participants
- Maintain appropriate conduct at all times
- Attend programs regularly and punctually
- Use equipment properly and safely
- Maintain academic standards as required by program participation
3.2 Prohibited Conduct
You may not use The Kumlawdi Foundation's website, programs, or services for any illegal or unauthorized purpose. Prohibited activities include but are not limited to harassment, abuse, discrimination, bullying, violence, theft, vandalism, use of drugs or alcohol, and any behavior that endangers the safety or well-being of others.
3.3 Program Modifications and Termination
The Kumlawdi Foundation reserves the right to modify, suspend, or terminate programs at any time. We also reserve the right to deny participation, suspend, or remove participants from programs for violations of program rules or these Terms. Participants who are removed from programs due to misconduct are not entitled to refunds of fees paid.
SECTION 4 - ASSUMPTION OF RISK AND RELEASE OF LIABILITY
4.1 Acknowledgment of Risk
By participating in The Kumlawdi Foundation programs, activities, or events, you acknowledge and agree that participation in physical activities, including but not limited to sports, training, and athletic activities, involves inherent risks of injury, including serious injury or death. You voluntarily assume all such risks.
4.2 Release of Liability
To the fullest extent permitted by law, you release, waive, discharge, and covenant not to sue The Kumlawdi Foundation Inc., its officers, directors, employees, agents, contractors, volunteers, and affiliates from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you or your child while participating in The Kumlawdi Foundation programs or activities.
4.3 Medical Clearance
Participants represent that they are in good physical condition and have no medical condition that would prevent them from safely participating in program activities. Participants and parents/guardians agree to consult with a physician before beginning any physical activity program if there are any concerns about health or ability to participate. Participants must disclose any medical conditions or limitations that may affect their participation.
SECTION 5 - VOLUNTEERS
Volunteers are essential to The Kumlawdi Foundation's mission. Volunteers must:
- Complete volunteer application and any required background checks
- Attend volunteer orientation and training
- Comply with all program rules and safety guidelines
- Maintain appropriate boundaries and professional conduct
- Respect the privacy and confidentiality of participants
The Kumlawdi Foundation reserves the right to decline volunteer applications or terminate volunteer relationships at any time.
SECTION 6 - PRIVACY
Your use of The Kumlawdi Foundation's website and participation in our programs is also governed by our Privacy Policy. By using our Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy. We respect the privacy of our participants and will not use media in ways that could cause harm or embarrassment.
SECTION 9 - DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
9.1 "As Is" Service
The Kumlawdi Foundation does not guarantee, represent, or warrant that your use of our website or participation in our programs will be uninterrupted, timely, secure, or error-free. You expressly agree that your use of, or inability to use, the services is at your sole risk. The services are provided "as is" and "as available" without any warranties of any kind, either express or implied.
9.2 Limitation of Liability
In no case shall The Kumlawdi Foundation, our directors, officers, employees, affiliates, agents, contractors, volunteers, or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the website or participation in programs, even if advised of their possibility.
Because some states or jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.
SECTION 10 - TERMINATION
10.1 Termination by Participant
Participants may withdraw from programs at any time by providing written notice to The Kumlawdi Foundation. Refund policies, if applicable, will be communicated at the time of registration.
10.2 Termination by The Kumlawdi Foundation
These Terms are effective until terminated by The Kumlawdi Foundation and may be terminated by The Kumlawdi Foundation at any time with or without notice. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term of these Terms, we may terminate this agreement at any time without notice.
10.3 Effect of Termination
Any such termination does not affect the enforceability of provisions that survive termination, including but not limited to the limitation of liability, warranty disclaimers, indemnity, and release.
SECTION 11 - GENERAL PROVISIONS
11.1 Entire Agreement
These Terms and Conditions constitute the entire agreement between you and The Kumlawdi Foundation with respect to the subject matter contained herein and supersede all previous and contemporaneous agreements.
11.2 Severability
If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
11.3 Waiver
The failure of The Kumlawdi Foundation to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
11.4 Modifications
We reserve the right to update, change, or replace any part of these Terms by posting updates and changes to our website. Your continued use of or access to the website or participation in programs following the posting of any changes constitutes acceptance of those changes.
SECTION 12 - GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes will be resolved in the state or federal courts located in Hillsborough County, Florida.
